Domestic Violence Charges Not Filed

A client was recently arrested for domestic violence, but attorney Metcalf acted fast to secure the best possible outcome. Not wanting his client unfairly convicted and labeled as an abuser because the police made an unjustified arrest, we negotiated with the prosecutor and the parties involved. By explaining the circumstances and filing a sworn request not to prosecute from the alleged victim, no charges were filed and he could put the incident behind him.

Probation Violation Dismissed

We recently helped a client charged with violating his probation. This was a serious situation because if convicted, he would be responsible for his original 15 year prison sentence. We reviewed the facts, and it became clear that the violation was based on a miscommunication about where he was permitted to work and whether he could drive as part of his employment. Not wanting our client returned to prison for such a minor violation, we fought for our client and advocated for his ability to earn a living. Prior to the final hearing, attorney Metcalf negotiated to have the probation violation dismissed.

2nd DUI Dismissed

We recently assisted a client accused of a second DUI after being stopped for rolling a stop sign. Since he had a prior DUI, a second conviction would almost certainly result in jail time and a long license suspension. We reviewed the evidence and uncovered several issues with the initial stop. We argued that the officers did not have a reasonable suspicion to conduct a DUI investigation, and they lacked evidence of impairment. Based on our presentation, the judge dismissed the DUI charge and our client was free to go.

Armed Robbery – Declined to File

Our client was accused of forcing an individual into his vehicle and robbing him at gunpoint before kicking him out of the car. Since the offense involved a firearm, our client was looking at significant time behind bars in addition to a felony conviction. We negotiated with the prosecutor, and they ultimately declined to file formal charges based on having such limited information. This no information filing spared was the best possible result for our client because it essentially means the incident never happened.

Our client was charged with misdemeanor battery after an altercation with a bar manager. If convicted, he potentially faced up to a year in county jail and a serious mark on his criminal record. We argued that he was actually defending himself at trial and the jury agreed. With a not guilty verdict, our client saw no negative effect on his life and was free to move on.
