2nd DUI Dismissed

We recently assisted a client accused of a second DUI after being stopped for rolling a stop sign. Since he had a prior DUI, a second conviction would almost certainly result in jail time and a long license suspension. We reviewed the evidence and uncovered several issues with the initial stop. We argued that the officers did not have a reasonable suspicion to conduct a DUI investigation, and they lacked evidence of impairment. Based on our presentation, the judge dismissed the DUI charge and our client was free to go.
