Fentanyl Trafficking Dismissed

Attorney Metcalf assisted a client in Pasco County, who was facing a minimum of 25 years in prison for trafficking fentanyl. The outlook was bleak, but attorney Metcalf took depositions from the investigating detective and scrutinized the search of the man’s truck that uncovered the alleged drugs. There were no plea offers made, and it became apparent that the prosecutor was aggressively seeking a conviction and the 25 year minimum mandatory prison sentence. Based on our investigation and the inconsistencies we found, attorney Metcalf filed and argued a motion to suppress. Though the officer changed his story at the hearing, attorney Metcalf used the officer’s prior sworn deposition testimony to show the judge the truth. Ultimately the judge agreed to suppress the illegally obtained evidence, and the entire case was dismissed.
