Ways of Challenging a Criminal Conviction
Following a conviction there are three different ways of challenging the conviction:
- A direct appeal of the conviction and sentence;
- A petition for habeas corpus; and
- A motion for post-conviction relief due to ineffective assistance of counsel.
A criminal conviction can be appealed directly following the verdict. If mistakes were made during the trial and the wrong evidence was used against you, then you have the right to challenge your conviction through a direct appeal. At Hillsborough Defense we will analyze the facts of your case and what happened during your trial to determine the best way to appeal your conviction.
There is a firm time limit for filing an appeal after a trial. If you or a loved one have been wrongfully convicted please do not hesitate to contact us today.
Habeas Corpus Petition
Even if the time for a direct appeal has passed, a conviction can still be collaterally attacked though a petition for habeas corpus. These petitions are typically reserved for serious cases, and can be a valuable tool for overturning a wrongful conviction.
What if the defense attorney made mistakes during your case? If those mistakes led to a conviction, you may be able to have your conviction reversed. Achieving post-conviction relief requires expertise. At Hillsborough Defense we are able to analyze the details of your case, and help you achieve the best result.
